A federal judge in Washington, D.C., struck down core provisions of three executive orders President Donald Trump issued to curb union power in the federal workforce late Friday.
U.S. District Judge Ketanji Brown Jackson, an Obama appointee, found that the orders violate the First Amendment, the separation of powers and the Federal Service Labor-Management Relations Act (FSLMRS) in a sprawling, 122-page decision.
Trump issued the trio of orders on May 25. Among other provisions, the directives restrict the amount of time federal workers may spend on official union duties, reduce performance-improvement periods for ineffective employees and narrow the range of issues that agencies and unions negotiate over when setting contracts.
“These executive orders make it easier for agencies to remove poor-performing employees and ensure that taxpayer dollars are more efficiently used,” White House Domestic Policy Council Director Andrew Bremberg said.
A coalition of labor unions challenged 20 different provisions in the directives, arguing that they violated the Constitution and the FSLMRS, a 1978 law securing collective bargaining rights for federal employees.
Jackson concluded that the president’s orders exceeded his authority as they effectively “eviscerate the right to bargain collectively as envisioned in the FSLMRS.”
The judge also rejected administration arguments that the orders were merely guidance that do not formally conflict with the FSLMRS.
“[S]uch directives can violate the duty to bargain in good faith that the FSLMRS prescribes,” she wrote.
American Federation of Government Employees President J. David Cox said in a statement that he was “heartened” by the decision.
“President Trump’s illegal action was a direct assault on the legal rights and protections that Congress specifically guaranteed to the public-sector employees across this country who keep our federal government running every single day,” Cox said.
The White House has not yet addressed Jackson’s ruling.
The decision can be appealed to the U.S. Court of Appeals for the D.C. Circuit.

The days of Federal employees being protected by extra measures like this Union.. are coming to an end. America’s government has become TOO big and TOO cumbersome. Add the fact that it’s near impossible to terminate employees.. even when they are not doing their job, or not even AT their job is ridiculous and wasteful for tax payers. I applaud our POTUS for trying to reduce the manpower by filtering out the underachievers and unnecessary people on payroll. The Government is supposed to work “for the people” not the People work to sustain Government which was what previous Presidents have allowed to happen.
Now we need to remove and/or replace all these warped, Liberal Judges Obama put on the bench. They are a threat to our government operating smoothly.
